User-Uploaded Content Policy

OrgasmDenial.com is committed to providing video galleries, photo galleries and discussion forums for the benefit of our members. The following document outlines the various laws we must abide by and the user-uploaded content policy we have developed in order to comply with these laws.
Content uploaded to OrgasmDenial.com by it's members must meet all of the following criteria:
1) You must have the legal right to publish the content (i.e. you are not violating anyone's copyrights by uploading it),
2) If the content contains nudity or is sexually explicit, we must have copies of government issued photo ID for the people in the photo or video (i.e. we must comply with the 2257 law),
3) The content must be relevant to the themes explored at OrgasmDenial.com.
Please note that this policy applies to user's profile photos. If you wish to have a profile photo that shows your genitalia, you must provide us with a copy of your photo ID.
Copyright
Copyright is a legal term that refers to the rights afforded to the creator of a photograph, video clip, piece of writing, audio recording, etc. Virtually all countries in the world are signatories to the various treaties that recognize the protection given to copyright holders. The rights are simple: the original creator of the work owns the copyright. The creator does not have to register their work with anyone nor do they have to affix the work with a copyright symbol ("©") for these rights to apply.
In the United States, the primary piece of legislation that governs the enforcement of copyright law is the
The Copyright Act of 1976 (http://en.wikipedia.org/wiki/United_States_Copyright_Act_of_1976). The law gives the creator of a work the exclusive right to copy, sell, publish, display and reproduce the work worldwide for the remainder of the creator's life, plus 50 years (subsequent legislation extended that period from 50 years to 70 years). Civil penalties for violating this law include statutory damages of a minimum of $750 and a maximum of $150,000 per infringement. Criminal penalties for violating this law include imprisonment for a minimum of 1 year (up to 10 years maximum, depending on the value of the infringed item).
There are two commonly held beliefs about copyright law. The first is that if a copyrighted work is given away for free (by, for example, being published in a free gallery on the Internet) that it is no longer protected by copyright law. The second is that copyright laws do not apply for non-commercial or not-for-profit uses. Both of these beliefs are false.

The law commonly known as "2257" refers to record-keeping requirements codified in 18 USC 2257. The law creates very specific record-keeping requirements for the creators and distributors of sexually explicit material. The law assumes that any model is a minor unless the producer and publisher can prove that he or she is an adult. Clarifying legislation was passed in late 2006 that, among other things, required web site publishers to meet the same record-keeping requirements as those who actually create adult content and expanded the definition of what constitutes sexually explicit material. In addition to severe financial penalties, violators of these laws face a jail term of up to 5 years in prison for each piece of content that violates the statute.
In October, 2007, the US 6th Circuit Court ruled the 2257 legislation to be unconstitutional, however the US Government request for a re-hearing has been granted so effectively this ruling has been nullified. As of August 2008, no date for the re-hearing has been scheduled. In any case, the 6th Circuit Court's ruling would have only applied in Kentucky, Michigan, Ohio and Tennessee. The existing law is still very much in force elsewhere in the country. The FBI has a dedicated inspection team in place who conducted 17 record-keeping inspections in 2007 and could resume these inspections at any time.
